4.0 Access and Correction

4.1 Where Abercromby’s collects information from you we will provide you with access to your information (subject to any reasonable charge as determined by Abercromby’s and notified to you before such access is given) at your request except that:

(a) the request for access is frivolous or vexatious;

(b) providing access would have an unreasonable impact on the privacy of others;

(c) the information relates to existing legal dispute resolution proceedings between you and Abercromby’s and the information would not be accessible by the process of discovery in those proceeding; or
